Labour Inspection Division
The Labour Inspection Division:
- carries out workplace inspections and criminal investigation to enforce the following legislation:
- Employment of Children Regulations which govern the employment of children in all economic sectors;
- Employment of Young Persons (Industry) Regulations which govern the employment of young persons in the industrial sector;
- Part IV of the Employees' Compensation Ordinance which provides for compulsory insurance in relation to compensation for work injuries;
- Part IVB of the Immigration Ordinance which prohibits the employment of illegal immigrants in Hong Kong;
- Employment Ordinance which protects employees’ right to timely payment of wages, also statutory benefits of rest days, statutory holidays, annual leave with pay, maternity leave, paternity leave, sickness allowance; and requires employers to keep and maintain records as required by the Ordinance, as well as not to default awards of the Labour Tribunal or the Minor Employment Claims Adjudication Board wilfully and without reasonable excuse; and
- Minimum Wage Ordinance which ensures employees are paid no less than the statutory minimum wage
- carries out inspections to the workplaces and accommodation of imported workers under the Enhanced Supplementary Labour Scheme and Sector-specific Labour Importation Schemes to ensure that workers entering Hong Kong for employment under these Schemes receive their statutory and contractual benefits
